I am writing to urge you to oppose Senate Bill 28 and any
similar legislation that would result in higher utility rates for Wisconsin residents. The Right of First Refusal (ROFR) legislation is particularly concerning as it blocks competition and entrenches monopoly control over electric transmission construction projects, inevitably leading to increased
costs for everyone.

Why Is ROFR Problematic?
- Eliminates Competition: Without competition, there are zero protections to keep
  costs down for ratepayers.
- Unconstitutional: Multiple federal courts have found ROFR laws to be unconstitutional.
- Already Higher Rates: Utilities have been awarded $2 Billion dollars in rate hikes since 2019. Wisconsin has gone from the lowest rates in the Midwest to the second highest.
- Economic Impact: Hurts manufacturers, stifles innovation and reduces the pocketbook
  of every Wisconsin family.
Competitive Bidding is PROVEN to Save Money
- New Jersey: Competitive bidding saved $900 million on a major transmission
  project.
- New York: The Empire State Transmission Line saved $500 million through
  competitive bidding.
I strongly urge you to vote NO on Senate Bill 28. Our energy
bills are already high enough in Wisconsin. We do not want a giveaway to the utilities that will only serve to drive our rate up further. Please protect our pocketbooks and competition and reject this legislation.
